<div><em><strong>ARD</strong> asked: </em><br/><br/><br/>Just found out today through a credit monitoring service of a collection by Santa Clara County, California for a Steady Red Circular Signal ticket dated April, 1997. The claims were a result of a September, 2007 (yes, over 10 years later) court appearance/judgment totaling $450. I spoke to the Department of Revenue Ticket Department and they had an old NY address. I moved out of the State of NY 9 years ago to the State of CT. To the best of my knowledge, I do not recall any notices 10 years ago to my NY address. So, a serious of questions pertaining to this case:</p>
<p>What are the Statute of Limitations for a 10+ year old ticket relative to a judgment date?</p>
<p>Do tickets have a default court date on the actual ticket itself that automatically satisfy Statute of Limitations and allow the case/violation to remain open?</p>
<p>I was not given notice of the 2007 court date so can that judgment  stand?</p>
<p>If I take the County to court to remove the judgment and clear my credit report, must they appear in the State that I reside or must this matter be addressed in a California court?</p>
<p>Are there consumer protection laws for the State of CT that provide for such protection?</p>
<p>Do you have any case law where Counties have been held for damages to credit reports (presuming, of course, the collection was not conducted legally)? If so, what are the typical damage calculations?</p>
<p>I did a bit of homework on this issue and it appears that California Penal Code 1382 governs this issue from a statute of limitations perspective. Any other reference to penal code or case law would be appreciated.</p>

If Turbo Tax is hacked, and customer information is stolen, what magnetude of a problem would there be? When the VA had it&#8217;s info stolen, the problem was limited to veterans and their dependents. But if Turbo Tax is hacked into and customers have their information stolen, the problem would affect EVERYONE who pays taxes and uses these sort of services. That&#8217;s allot of credit monitoring for a lifetime.<br />
Would you join the band wagon and agree to a civil-lawsuit against this type of company if they had an intrusion of their computers and you were &#8216;a possible&#8217; victim?<br />
If it&#8217;s a stand alone product, why is there an account on their site that keeps track of your past activity to include your last tax fileing? I seriously doubt they don&#8217;t keep your personal information.<br />

Regardless of what information was stolen, it could be:<br />
SSN, Disabilities, Bank acct #, Name and address, Dependents, etc&#8230;<br />
All of which is personal.<br />

Regardless of any liability statement, there are always ways to take the issue to court. Liability statements are just a formality, kinda like your job application stating they can fire you at any time for no reason. But obviously, they can&#8217;t&#8230;not unless you get some $$ out of it or u really deserved to get fired/layed off.<br />

monitoring services.  Is there a legal advice website or forum where I can<br />

Records show that you entered into an agreement over the Internet with ConsumerInfo.com or an Experian Entity to purchase any Credit Check or Credit Check Monitoring (which were formerly known as CreditCheck® Monitoring Service), Credit Manager (including Yahoo! Credit Manager), Triple Alert, or Triple Advantage credit-monitoring product, or you paid for a credit score sold on a website that also sold one of these credit-monitoring products, between June 17, 1998 and December 27, 2006. If so, you may be eligible to receive a benefit under the proposed settlement.</p>
<p>     The settlement will resolve a lawsuit over whether Defendants violated the federal Credit Repair Organizations Act or are liable for claims where the stated basis is about improvement of a consumer&#8217;s credit record, history, or rating. Under the settlement, Defendants deny that they are liable, but have agreed not to make certain statements on particular websites and to provide all Settlement Class Members with the opportunity to obtain their choice of a settlement benefit: either (i) a credit score or (ii) 60 days of credit monitoring, as described below and on the settlement website. <p>Please respond only if you have a high level of understanding of credit and please provide supporting evidence/references (An excerpt from FCRA would be great!). Please do not respond with a quip just to get some answer points, thank you!</p>
<p>BTW did you guys hear Obama today?!? Credit heaven for consumers is coming soon! No fee hikes whenever they want, no hidden fees! An oversight executive type agency to monitor the bureaus and lenders, not just the dumb old silent FTP. Plain language, lots more! Google it! Just happened today!</p>

Yes, I am disputing with Experian, but they have blocked me before. They will look at something they have already verified IF there are additional supporting documents. I am using the fact that the other two buereaus have both deleted this account as additional supporting documentation.   Note: This account WAS reported on all three bureaus, its VERY old, and they are no longer attempting to collect this debt. It was deleted b/c of that fact from TU and EQ, and I am filing a dispute with EX to have it re-investigated. My basis in my letter was that it was removed from the other bureaus, and under the FCRA they have an obligation to maintain consistency with the other bureaus (kind of a 2 vs. 1 thing). So 2/3 bureaus are now accurate. I was hoping to have supporting legislative documentation from the FCRA to invoke this pursuant to &#8230; and thats really my question.
