Social security # at risk, can I sue?

honeyskillz asked:

I applied to work for Gap Inc. in June of 2007. Today I got a letter in the mail from them stating that 2 laptop computers from the company had been stolen and my name and social were stored in one of them. They offered credit monitoring for the next year, but as a 16 year old trying to establish credit I fear for my future credit. This applied to the times of July 2006-June 2007. Can I sue?

Can you sue – yes. Can you prevail is another question. If you can prove that they failed to provide due diligence (you may need to prove damages depending on your states privacy laws) in the protection of your information the answer is probably yes, but if the items where stolen and due diligence was practiced no. If due diligence was not followed and someone uses your information and you are damaged definitely.

I guess you can sue for any reason now days. I would take the credit minoring and tell them if my number gets used I will sue them for everything it was used for.

My wife received that letter from Gap Inc. today…

being the skeptic that I am, i think it might be a scam to give you a free year and then charge you afterwards… kind of a backwards marketing scheme for Experian.

I am still researching this and will call Gap Inc headquarters tomorrow to verify.
